摘　　要：当前我国犯罪活动呈现社群身份性现象,认罪认罚从宽制度改革深入推进,传统刑罚观理论对此解释力不足。沟通式刑罚观契合了当下中国实际,以社群主义作为法哲学基础,将犯罪人所属的规范社群纳入沟通主体范围,强调刑罚的教育目的。通过树立沟通式刑罚观,将刑罚处罚重心从秩序维护转向价值宣示,以沟通的方式传达犯罪人所应得的责难并最终弘扬社群共同价值,调整刑罚结构,消除犯罪标签,激活社群内部纠错机制,推动谦抑人道、相称多赢刑事制度的构建。At present,China’s criminal activities show the phenomenon of community identity.The reform of the leniency system of confession and punishment has been further promoted,and the traditional penalty theory has insufficient explanatory power.The communicative penalty view conforms to the current reality of China,takes communitarianism as the basis of legal philosophy,brings the normative community to which the offender belongs into the scope of communication subjects,and emphasizes the educational purpose of punishment.By establishing a communicative penalty view,we shall shift the focus of punishment from order maintenance to value declaration,convey the blame that criminals deserve by means of communication,and finally promote the common values of the community,in order to adjust the penalty structure,eliminate the crime label,activate the internal errorcorrection mechanism of the community,and promote the construction of a modest,humane,proportionate and win-win criminal system.
