“战后正义”理论若干问题探析

摘　　要：从20世纪90年代开始,随着以美国为首的西方国家发动多起干涉战争,战后正义成为学术界关注的一个热点,人们关心处置战败国的正义性问题。本文全面梳理了“战后正义”理论的研究概况,探讨分析战后正义的特点、标准和影响。本文认为:“战后正义”理论是正义战争理论的一部分,有丰富的内涵和特点。与开战正义和交战正义相同,战后正义也需要有相应的标准。战后正义的标准涉及四个方面:一是非歧视性,二是正当性,三是有限性,四是谨慎性。“战后正义”理论进一步完善了传统正义战争理论,为审视战争的正义性提供了新的视角和新的理念,对国际关系理论和国际政治的实践,产生了深远的影响。Since the 1990 s,following the wars of intervention launched by the Western countries particularly the United States,Jus Post Bellum has become a hot topic in academic circles,and people have been concerned about the justice around the defeated countries.This paper comprehensively reviews the existing literature on Jus Post Bellum theory and discusses the characteristics,standards and influence of Jus Post Bellum.This paper holds that Jus Post Bellum is a component of the just war theory and reflects connotation and characteristics of the theory.Like the just of war and the just in war,Jus Post Bellum requires its own criteria.The criteria of Jus Post Bellum involves four aspects:indiscrimination,legitimacy,limitation and prudence.The concept of Jus Post Bellum makes a contribution to development of the traditional just war theory,offers a new perspective and idea for examining the justice of war and has a profound impact on the theory and practice of international relations and politics.
