非自然性交方式性侵幼女的刑法规制

摘　　要：强奸罪中“奸淫”内涵过于狭隘,猥亵儿童罪中“猥亵”则外延过于扩充,将非自然性交方式性侵幼女行为以猥亵儿童罪规制,有违罪责刑相适应原则,不利于幼女性权利保护和预防犯罪。非自然性交方式与自然性交方式在对幼女性权利的侵害上具有等价性,性行为在我国卖淫类犯罪中已做扩大解释,国际组织、域外和我国港台地区也将非自然性交方式明确规定为性交行为。顺应时代发展趋势,应将非自然性交方式性侵幼女的行为以强奸罪规制。The connotation of“rape”in the crime of rape is too narrow,and the extension of“indecency”in the crime of child molestation is too expanded.Regulating unnatural sexual intercourse against underage girls as the crime of child molestation violates the principle of suiting responsibility and punishment to crime,and it is not conducive to the protection of the sexual rights of underage girls and the prevention of crimes.Unnatural sexual intercourse methods and natural sexual intercourse methods are equivalent in infringing on the sexual rights of underage girls.Sexual behavior has been explained extensively in prostitution crimes in our country.International organizations,foreign countries,Hong Kong and Taiwan in our country have also clearly defined unnatural sexual intercourse as sexual intercourse.Conforming to the development trend of the times,the act of sexually assaulting underage girls by means of unnatural sexual intercourse should be regulated as the crime of rape.
