摘 要:为了优化监管效能,强化机构自我约束、政府行政约束和市场约束的力量,财险产品监管应该贯通行为监管与审慎监管,形成“产品—机构—市场”一体化监管,统筹实现公平、安全、稳定的监管目标。对比国际财险产品监管制度与共识,我国现行的“前置式、分层式、分类式”监管框架总体合理,但财险产品市场和产品监管的方法手段还存在不少问题,需要结合行为监管与审慎监管,创新监管制度方法,加强偿付能力监管、公司治理和信息披露,构建“高效、透明、负责、公平”的财险产品监管体系,实行更精准的分类监管,把更多监管资源配置到易受侵害的个人消费者领域,适度放开企业客户和国家重点战略领域的前置措施,鼓励和保护财险产品创新,贯彻新发展理念,支持经济高质量发展。监管科技影响产品监管的成本与收益,要建立科技驱动式产品监管机制,建设财险产品监管数字化基础设施,应用监管科技增强监管能力,降低监管成本,提高分层体系下监管一致性水平。Property insurance product regulation should combine behavioral supervision and prudent supervision to form an integrated "product-institution-market" regulation, in order to optimize the regulatory effect, and strengthen the forces such as insurer self-constraint, government administration constraint and market constraint, and achieve the regulatory objectives of equity, security and stability.In comparison with international regulatory systems and consensuses, the current "front-ended, multi-tiered, categorized" regulatory framework is generally viable, but there remain some problems in terms of regulatory means on property insurance products and markets.We should innovate on the regulatory system and measures through combining behavioral supervision and prudent supervision, strengthen solvency regulation, corporate governance and information disclosure, aiming to construct a "highly efficient, accountable, and equitable" property insurance product regulatory system, and realize more precise and categorized regulation.Moreover, more regulatory resources should be allocated to the vulnerable individual consumer fields, appropriately lift front-ended measures on corporate clients and key national strategy fields, encourage and protect property insurance product innovation, implement new development concepts and support high quality development of the economy.Regulatory technology has a bearing on the cost and return of product regulation, therefore we should establish a technology-driven product regulatory mechanism, build up the digital infrastructure for property product regulation, enhance the regulatory capability with technologies, reduce regulatory costs and enhance the consistency of the categorized regulation system.
