摘 要:《民法典》并未否认物业服务人对物业服务区域内的物和人所享有的管理权,但此规定下的管理权未能全部涵盖物业服务人基于基层治理的目的在物业服务区域内的管理需要。既有的管理权在救济上存在着诉权授权不清、可以请求的责任承担方式较为单一等问题。虽然管理规约在制定和施行层面仍遭遇着诸多困境,但仍不失为对物业服务人的管理权制度优化的一条有效路径。可通过在管理规约中约定物业服务人享有特定的管理权并辅之以相应的责任承担方式予以实现。The Civil Code does not deny the property service provider’s management rights over the property and persons in the property service area,but the existing management rights of the property service provider cannot fully cover its management rights that need to manage the people in the property service area based on grassroots governance,and the existing management rights have many problems such as uncertain authorization of the right of action and the comparatively single way of bearing the responsibility that can be requested.Although the management statute still confronts many difficulties at the level of formulation and implementation,it is still an effective way to optimize the management rights system of the property service provider,which can be achieved by stipulating in the management statute that the property service provider shall enjoy specific management rights and be supplemented by corresponding responsibility assumption.
