“私有共治”的集体行动逻辑及其内在机理——以浙江省M村水田治理为例

摘　　要：“私有共治”是产权与治理的一种新的组织形态,是一种具有良性自主治理能力的集体行动模式,通过“公共利益”等公共性元素的存在及作用机制,实现了形态上的“自由人联合体”,从而达到共益共赢的治理效果。分析传统时期农村水田治理过程中的集体行动个案发现,共同利益、权威主体、自主组织、共享规范是开展“私有共治”集体行动的条件,激励机制、保障机制和权变机制是形成民间社会自治规则、实现有效自主治理的重要制度设计。未来,应在吸收传统的“私有共治”的治理模式的经验基础上,充分发挥农民自主治理的主体性地位和功能,引导他们通过创造条件、创设制度、创建机制等开展自主治理,进一步提升乡村治理效能。“Private ownership and shared governance”,as a new organization form of property right andgovernance,is a mode of collective action with healthy self-governance capacity.By means of the existenceand action mechanism of public elements including public interest,it realizes a modal community of freeindividuals and the governance effect of mutual-benefit and mutual-win as well.A case study of collectiveactions in the paddy field governance process of traditional rural area discovers that the conditions forcarrying out collective actions based on“private ownership and shared governance”are common interest,authoritative subject,self-organization,and shared regulation;and that the incentive mechanism,safeguard mechanism,and contingency mechanism are important institutional designs for the folk society toform self-governance regulations and achieve effective self-governance.Based on the experience oftraditional governance model of“private ownership and shared governance”,the farmers should be given afull play of their subjectivity and function in self-governance;by creating conditions,establishing systemsand mechanisms,they should be guided to implement self-governance so as to further promote the efficacyof rural governance.
