摘　　要：《中华人民共和国民法典》第一千一百七十六条对体育侵权抗辩事由进行规定后,自甘风险的适用性有了法律依据。人们追求文体类活动刺激性的同时,也应关注其背后存在的隐患。当文体类活动的伤害事故发生时,应当如何正确使用自甘风险规则将受害人和行为人的责任进行平衡值得探究。纵观英美法系在自甘风险规则适用上的发展历程,结合我国在实务中的自甘风险规则适用,对自甘风险规则的适用范围与适用条件进行明确,可以避免人们陷入误区。Article 1176 of Civil Code of the People’s Republic of China provides a legal basis for its application after the provision of sports infringement defense.While people pursue the excitement of recreational activities,they should also pay attention to the hidden dangers.This paper explores how to correctly apply the assumption of risk rules to balance the responsibilities of victims and actors when injury accidents occur in recreational activities.Reviewing the development process of the application of assumption of risk rules in Anglo-American law system,combining the relevant situations that have been applied in practice,the author makes clear the application scope of the rules and the applicable conditions,so as to avoid misunderstanding.
