跨界流域水资源管理冲突体制性障碍及其优化路径

摘　　要：探讨跨界流域水资源管理冲突的制度性障碍,可为推动全流域综合治理提供理论支撑。研究方法:文献分析法。研究结果:1)跨界流域自然生态流域系统完整性与行政区划发展定位的分割性不相同;2)跨界流域水资源管理冲突制度性障碍主要体现在流域行政区划分割、部门职能重叠和法律建设不足;3)建立统一管理体系、整合流域水资源管理机构以及整体性协调管理机制是实现跨界流域一体化治理的有效途径。研究结论:剖析跨界流域水资源管理冲突中行政利益主体分割、部门利益冲突及其法律体系不健全问题并提出障碍优化路径,可为全流域水资源深化“跨界融合”协同治理研究提供新视角。The purpose of this paper is to discusses the institutional obstacles to the management conflict of water resources in transboundary river basin and lays a theoretical foundation for promoting the integrated development of river basin.The methods of the literature analysis and summarization were employed to analysis the institutional barriers to transboundary watershed water management conflicts.The results shows that:1)It shows that the integrity of the natural ecological law of the transboundary river basin system is incompatible with the segmentation of the development orientation of the administrative division;2)It demonstrates that the institutional obstacles to the management and utilization conflict of water resources in transboundary river basins are mainly manifested in the impact of the segmentation of river basins,the division of functional departments and the imperfect legal construction;3)It suggests that the establishment of a unified management system,the integration of river basin water resources institutions and the unified coordination and management mechanism is an effective way to realize the integration of cross-border river basins.It concludes that the analysis of the institutional obstacles to the conflict management of water resource utilization in transboundary river basin and provides a new research perspective for the conflict of water resource utilization in transboundary river basin.An unfavorable situation has been formed in which each administrative region and department are the main interest subjects in the division of river basin water resources,and it results three aspects of the institutional obstacles to the management and utilization conflict of water resources,destroys the basin natural unit and its integrity.Therefore,in order to solve the institutional obstacles of water resources management in the trans-boundary basin system,it is necessary to establish comprehensive water resources management institutions from the central to the local and from the basin to the region,clar
