体教融合视域下青少年体质健康促进政策法律化研究

摘　　要：新时代以公共政策推进为导向的政策法律化探索和试验有效保障了青少年体育治理的持续改善。在深化体教融合的背景下,聚焦当前青少年体质健康促进政策法律化的价值意蕴,审视青少年体质健康促进政策和有关法律的现实困境,进而提出政策立法的可行进路。研究认为,青少年体质健康促进政策法律化的价值意蕴主要体现在政策法律化是实施依法治体持续发展的时代诉求,政策法律化是保障行为主体权利和义务的客观要求,政策法律化是引导大健康治理现代化的价值追求,政策法律化是推动学校体育立法改革的必然选择。现实困境主要有政策与法律协同治理机制不畅,政策执行偏离政策愿景。因此,有必要从健全青少年体质健康促进政策立法的顶层设计,形成体质健康政策法律化的立法先行共识,明确政策制定主体的权力配置,改善政策法律化实施的外部法治环境4个方面进行路径优化。In the new era,the exploration and experiment of policy legalization guided by the promotion of public policy has effectively guaranteed the continuous improvement of teenager sports governance.Under the background of deepening the integration of sports and education,this paper focuses on the value implication of the legalization of the current teenager physical health promotion policy,examines the practical difficulties of the teenager physical health promotion policy and relevant laws,and then puts forward a feasible approach to policy legislation.This study elucidates that policy legalization is the demand of the times for the sustainable development of governing sports by law and the objective requirement to ensure the rights and obligations of behavior subjects.Moreover,policy legalization is the value pursuit of guiding the modernization of great health governance and also the inevitable choice to promote the reform of school sports legislation.The practical difficulties mainly include the poor coordinated governance mechanism between policy and law and the deviation of policy implementation from policy vision.Therefore,it is necessary to optimize the approach by improving the top-level design of teenager physical health promotion policy legislation,forming a legislative first consensus on the legalization of physical health policy,clarifying the power allocation of policy-making subjects,and improving the external legal environment for the implementation of policy legalization.
