摘　　要：美国为了自身利益滥用“协商一致”原则导致上诉机构停摆后,世贸组织争端解决机制受到重创。世界需要一个运行正常的多边贸易争端解决机制,以阻止世界贸易环境重回GATT时期。《多方临时上诉仲裁安排》是针对目前上诉机构危机提出的解决方案,其除了在上诉机构瘫痪期间临时代替上诉机构职能的临时性外,还可在上诉机构恢复后作为上诉机构的补充制度,分担上诉机构的压力。现行的《多方临时上诉仲裁安排》基础运行框架仅限于满足临时性需要,若将其作为上诉机构的长期补充程序,需要对争端解决机制、与上诉机构衔接、仲裁员机制、上诉机构报告与仲裁裁决适用机制进行构造。After the suspension of the appellate body due to the United States’abuse of principle of“consensus”for its own interests,the WTO dispute settlement mechanism was hit hard.The world needs a functioning multilateral trade dispute settlement mechanism to prevent the world trade environment from returning to the GATT period.The Multi-Party Interim Appeal Arrangement is a solution to the current crisis of the appellate body.In addition to the temporary nature of temporarily replacing the functions of the appellate body during the paralysis of the appellate body,it also has a supplementary system as the appellate body after its restoration to share the pressure of the appellate body.The basic operation framework of the current Multi-Party Interim Appeal Arrangement is limited to meeting its temporary needs.If it is used as a long-term supplementary procedure of the appellate body,it is necessary to construct the dispute settlement mechanism,connection with the appellate body,arbitrator mechanism,appellate body report and arbitration decision application mechanism.
