摘　　要：随着协商行政理念的兴起,我国行政执法方式正逐渐从命令强制式向协商与合作式转变,协商式行政执法正逐渐适用于行政执法实践中。但由于协商行政执法行为指导原则不统一、协商范围和方式不明确、协商结果效力不确定、协商程序虚无化、监督机制不健全等问题,使得协商式行政执法行为杂乱无章、弊端丛生,亟需实现法制化。立法机关应该重点对协商的基本原则、范围和方式、程序、效力和监督机制等内容进行法制化构建,以期为协商式行政执法行为提供明确的法律指引和规范约束。With the rise of the concept of consultative administration,the way of administrative law enforcement in China is gradually changing from order coercion to negotiation and cooperation.Consultative administrative law enforcement is gradually applied to the practice of administrative law enforcement.However,due to the non-uniform guiding principles of consultative administrative law enforcement,unclear scope and mode of consultation,uncertain effectiveness of negotiation results,nihilistic negotiation procedures,imperfect supervision mechanism and other problems,consultative administrative law enforcement is disorderly and has numerous disadvantages,which urgently needs to be legalized.The legislature should focus on the legal construction of the basic principles,scope and methods,procedures,effectiveness and supervision mechanism of consultation,in order to provide clear legal guidance and normative constraints for consultative administrative law enforcement.
