摘 要:按照环境无害化管理原则,严格限制危险废物越境转移活动是中国履行《控制危险废物越境转移及其处置巴塞尔公约》的重要内容。本研究通过梳理《控制危险废物越境转移及其处置巴塞尔公约》关于控制危险废物越境转移的主要规定和中国立法管理实践,全面分析了中国控制危险废物越境转移管理进展。从打击非法转移、完善法律基础、建立预警机制等方面,深入剖析了中国控制危险废物越境转移面临的形势,并从强化危险废物越境转移管控、严厉打击非法出口行为、联合海关部门加强日常监管三方面提出对策建议,以期为中国全面履行《控制危险废物越境转移及其处置巴塞尔公约》要求、控制和防范危险废物越境转移环境风险提供支撑。Strictly restricting the transboundary movement of hazardous wastes in accordance with the principles of environmentally sound management is an important part of China’s implementation of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal.This study comprehensively analyzes the progress of China’s management of the control of transboundary movements of hazardous wastes by sorting out the main provisions of the Basel Convention.From the aspects of cracking down on illegal transfers,improving the legal basis,and establishing an early warning mechanism,this paper deeply analyzes the situation China faces in controlling the transboundary transfer of hazardous wastes,and put forward countermeasures and suggestions from three aspects,strengthening the management and control of the transboundary movement of hazardous waste,cracking down on illegal exports,and strengthening the daily supervision of the customs department.The research conclusions can provide supports for China to implement the requirements of the Basel Convention and prevent the environmental risks of the transboundary movement of hazardous wastes.
