摘　　要：人的尊严是宪法上的最高价值,它不是一项宪法基本权利。人的尊严是法益的基础,它不是具体犯罪保护的客体。人的尊严是指社会成员基于相互承认和彼此尊重,对其之间形成的平等地位及主体资格免遭否定和促进实现的价值实践。收买被拐卖的妇女罪侵犯了彰显妇女尊严价值的人身自由权利。法益概念只具有一定的立法批判机能和解释指导机能,所以,对本罪的犯罪化合理性及其刑罚化均衡性研究,还需从刑法体系外寻找刑事政策学、犯罪学上的根据。详言之,本罪采取了分立式立法技术,与拐卖妇女罪构成非对称型对向犯,且近年来对妇女尊严价值的侵害程度日益提升。然而,即使对本罪的法益侵害性、非难可能性的评价趋于严厉,也不一定要提高法定刑,严格刑罚裁量和强化行政执法都是可以考虑的方案。Human dignity is the highest value in the constitution,and it is not a basic constitutional right.Human dignity is the basis of legal interest,and it is not the protected object of specific crimes.Human dignity refers to the value practice that social members avoid negation and promote the realization of their equal status and subject qualification based on mutual recognition and respect.The crime of buying abducted and trafficked women violates the right to personal freedom that demonstrates the value of women’s dignity.The concept of legal interest only has a certain function of legislative criticism and interpretation guidance.Therefore,the research on the rationality of criminalization and balance of penalty of this crime also needs to find the basis of criminal policy and criminology outside the system of criminal law.In detail,this crime adopts discrete legislative technology,which constitutes an asymmetric opposite crime with the crime of abducting and trafficking in women,and the degree of infringement on women’s dignity value has increased in recent years.However,even if the evaluation of the infringement of legal interest and the possibility of criticism of this crime tends to be severe,it is not necessary to improve the statutory penalty.Strict penalty discretion and strengthening administrative law enforcement are all options that can be considered.
