收买被拐卖的妇女罪背后的乡土失序与规范重构

摘　　要：分析收买被拐卖的妇女行为的罪与罚,应当区分事实与规范两个层面。收买被拐卖的妇女犯罪的线索发现难、追诉到位难、实际处罚轻、逆反作用强等现象,属于评价该类罪行的事实层面,其事实语境是乡土失序。收买被拐卖的妇女罪的法定刑格低、数罪并罚少、重罪吸收少等现象,属于评价该类罪行的规范层面,其规范语境是规制体系失衡。事实与规范两个层面不能直接联通,既不能以事实层面的困难来注解规范层面的规制体系失衡,也不能以规范层面的规制体系失衡赋予事实层面的乡土失序合理化。促成两者联通的路径是贯彻刑事政策,通过落实宽严相济刑事司法政策推动乡土秩序转型,通过落实预防型刑事立法政策推动规范重构,共同提升规制拐卖妇女犯罪的刑法保障效能。When analyzing the crime and punishment of buying abducted women,we should distinguish between facts and norms.The phenomena of buying abducted women,such as difficult to find clues,difficult to prosecute at once,light actual punishment and strong adverse reaction,belong to the factual level of evaluating this kind of crime,and its factual context is earthbound disorder.The phenomena of low legal punishment,less combined punishment for several crimes and less absorption of serious crimes of buying abducted women belong to the normative level of evaluating such crimes,and its normative context is the imbalance of the regulatory system.The two levels of fact and norm cannot be directly connected.We can neither annotate the imbalance of the regulatory system at the normative level with the difficulties at the factual level,nor rationalize the earthbound disorder at the factual level with the imbalance of the regulatory system at the normative level.The way to promote the connection between the two is to implement the criminal policy,promote the transformation of earthbound order through the implementation of the criminal justice policy of tempering justice with mercy,and promote the reconstruction of norms through the implementation of the preventive criminal legislation policy,so as to jointly improve the effectiveness of criminal law in regulating the crime of buying and selling women.
