On Police Power’s Assistance in the Implementation of Supervisory Detention

摘　　要：虽然《监察法》和《监察法实施条例》为留置的适用及协助执行提供了基本法律框架,但警察权协助执行监察留置还存在诸多问题,直接影响法律实施、制度衔接及人权保障。警察权协助执行监察留置的必然性,由留置措施的限制人身自由性质、警察权的专属性以及监察权与警察权之间的权力配置所决定。警察权协助执行监察留置须遵从监察权调动警察权的界限、行使警察权的种类界限、警察权自身的运行界限这三重界限。为防止协助执行留置措施中的权力任性滥用,需要从协助需求侧的监察权和协助供给侧的警察权两端,强化对权力的制约规范,更好发挥警察权协助执行监察留置的制度效能。Although the Supervision Law and its implementation regulations provide a basic legal framework for the application and assistance of supervisory detention, there are still quite a few problems especially in the police power’s assistance in the enforcement of supervisory detention, which directly affect the implementation of supervisory laws and regulations,connection of legal systems and protection of human rights. The inevitability of the police power to assist supervisory detention is determined by the nature of supervisory detention, the specificity of police power, and power allocation between supervisory power and police power. Police power in assisting supervisory detention must comply with triple boundaries, including supervisory power boundary of mobilizing police power,the type boundary of exercising police power,and the operation boundary of each kind of police power itself. In order to prevent the arbitrary abuse of power,it is necessary to strengthen the restriction of power from two sides of the supervisory power and the police power,so as to give better play to the system efficiency of police power’s assistance in the implementation of supervisory detention.
