日本图书馆复制权制度的立法与适用刍议

摘　　要：日本图书馆复制权制度较为健全,不仅体系相对完整,而且适用范围广泛。日本图书馆复制权制度的不断完善与日本文化立国战略的实施紧密相关。在建立与创新图书馆复制权制度的过程中,日本立法机关注重听取图书馆界的意见,能够根据技术发展和社会对图书馆服务需求的变化及时修法,并且制度规范具体与详细。另外,日本图书馆界也把切实保护著作权,维护权利人的合法利益,树立遵守法律法规的良好社会形象,作为使自身诉求得到立法支持的重要策略之一。日本健全图书馆著作权制度的一些做法与经验对我国相关法律制度建设具有启示意义。The system of the right of reproduction is relatively sound in Japanese libraries,not only with a relatively complete system but also with a wide range of application.The continuous improvement of the system of the right of reproduction in Japanese libraries is closely related to the implementation of the strategy of Japa⁃nese culture.In the process of establishing and updating it,the legislature considers the appeal of library cir⁃cle seriously,revising the legislation in time according to technological development and changes in the so⁃ciety's demand for library services,and the specifications are specific and detailed.In addition,Japanese li⁃brary circles also take effective protection of copyright,safeguard the legitimate interests of rights holders,and establish a good social image of abiding by laws and regulations as one of the important strategies to ob⁃tain legislative support for their own demands.Some practices and experiences of perfecting the system of the right of copyright in Japanese libraries will be enlightening to the construction of relevant legal system in China.
