摘　　要：针对域外关于算法定价中合谋问题的反垄断规制问题研究,国内进行系统性介绍的文献很少,而域外经验的系统梳理应包括理论研究、司法实践与立法建构等三个主要部分。总的来说,域外对算法合谋中的垄断风险大多持乐观态度,各国的法律规制实践也多有相似之处。通过分析这些法律的实践现状及总结其相应的风险化解与防范逻辑,有利于中国对算法合谋反垄断规制的治理。本土方案的建立应当包括“当下”和“长期”两个方面。当下,应对已有的算法合谋垄断问题进行针对性治理,治理类型应以主体而非算法类型来划分;长期,应在现有《反垄断法》修订背景下,对算法合谋及其后续延伸问题进行系统的规则构造,如数字经济条款专章的设立,等等。通过梳理域外现有治理经验,有助于增进对算法垄断风险的认知,更重要的是可以通过他山之石对中国的治理实践进行镜鉴。For the research on anti-monopoly regulation of collusion in algorithmic pricing abroad,there are few domestic literatures systematically introduced,and the systematic review of foreign experience should include three main parts:theoretical research,judicial practice and legislative construction.Generally speaking,foreign countries are optimistic about the monopoly risks in algorithmic collusion,and there are many similarities in the legal regulation practices of various countries.By analyzing the practical status of these laws and summarizing the corresponding risk resolution and prevention logic,it is conducive to China’s governance of algorithmic collusion anti-monopoly regulation.The establishment of local solutions should include both“present”and“long-term”aspects.At present,the existing algorithmic collusion monopoly problem should be subject to targeted governance,and the governance type should be divided by the subject rather than the algorithm type;in the long term,we should systematically construct rules for algorithmic collusion and its subsequent extension under the background of the revision of the existing anti-monopoly law,such as the establishment ofspecial chapters on digital economy articles.By reviewing the existing governance experience abroad,it will help to improve the understanding of the risk of algorithmic monopoly,and more importantly,we can borrow foreignexperience for China’s governance practice.
