谔谔之士的法科“棱角”——纪念伍廷芳逝世一百周年

摘　　要：1922年6月23日伍廷芳逝世,今年是伍氏逝世100周年。众所周知,伍廷芳在修订法律、支持共和、中外交涉等方面有大功。伍廷芳离世仅十天的时候,有个“新文化”领袖人物发表文章,把伍氏的事功说成“福份”,说他的性格“古怪”和“浅薄”。应该怎么评价伍廷芳?法律人原本鲜明的专业性格,在有“棱角”的伍廷芳身上更容易放大,因此更容易受误解。迄今时间已过去百年,人们对其为人之个性、做事之格局以及生活之格调却并不甚了解,乃至有误解。在笔者看来,伍廷芳有“棱角”却能够受各方接受,是有其中原因的。他的追求是共和与法治,他的格局是世界与文明。在此作些述评,亦是对他的纪念。Wu Ting-fang died on June 23,1922.This year marks the 100 th anniversary of Wu’s death.It is well-known that Wu Ting-fang has made great contributions to revising laws,supporting the Republic and diplomatic negotiations.Only ten days after Wu Ting-fang’s death,a leader of the“New Culture Movement”wrote an article describing Wu’s achievements as“blessing”,and said that Wu’s character was“eccentric”and“shallow”.What should be said about Wu Ting-fang?The inherent distinctive professional character of a legal person is more likely to be magnifiedon Wu Ting-fang,who has“edges and corners”which makes him easier to be misunderstood.A hundred yearshave passed,and not much is known aboutthe way how he behaved,worked and lived.In my opinion,there is a reason why Wu Ting-fang was accepted by all parties despite his“edges and corners”.His pursuit was for the Republic and the rule of law,and his visionwas for the world and civilization.It is also a memorial to him to make some comments here.
