区域协同立法的运行模式与制度保障

摘　　要：区域协调发展战略的实现需要区域协同立法提供个性化的制度保障。区域协同立法是非隶属的地方立法机关相互配合、相互协助,为解决区域公共事务提供区域规则、衔接规则的地方立法活动,是建立更加有效区域协调发展新机制的重要制度供给路径。为确保区域协同立法在法治框架下为区域协调发展提供完备的区域法规范体系,应当针对征求意见模式、示范协调模式和共同协商模式等区域协同立法不同运行模式分别予以规范化、制度化、法治化,并从建立交叉备案与动态清理机制、健全社会参与和信息公开共享机制、优化区域协同立法交流学习与智力支持机制、完善区域协同立法后评估和立法考评机制等方面着手建立健全相应的配套保障机制。The realization of regional coordinated development strategy needs the regional cooperation in Legislation to provide targeted system guarantee.The regional cooperation in legislation is a kind of local legislative activities in nature,which need mutual cooperation and mutual assistance among local legislatures without subordinate relationship,in order to provide regional rules and connection rules for solving regional public affairs.Meanwhile,it is an important institutional supply path for establishing a new mechanism of more effective for regional coordinated development.In order to ensure that the regional cooperation in legislation provides a complete normative system of regional law for regional coordinated development under the framework of the rule of law,it is ought to standardize,institutionalize and legalize the different operation modes of the regional cooperation in legislation,such as opinion-seeking model,demonstrating coordination model and common negotiation model.Moreover,it ought to build and improve the corresponding supporting guarantee mechanism for the regional cooperation in legislation by establishing a cross-filing and dynamic clearing mechanism,improving social participation and information sharing mechanism,optimizing the regional cooperative legislation exchange learning and intellectual support mechanism,and perfecting the post-legislation evaluation and legislative evaluation mechanism of regional coordination.
