摘　　要：数字时代带来新的风险,传统的法治理念及其系统性制度设计所形成的普遍主义法治秩序,面临严峻挑战。既有研究因研究视角和研究方法的缺位,以及缺乏统一的网络数字法理支撑,未能形成一个独立的有共同话语基础的知识群体,使网络空间治理相关问题的解决呈碎片化状态,并在实践中表现为一种应急治理模式。应当立足网络空间治理的整体,形成一个数字法学研究共同体,澄清数字法作为一种新兴领域法的外部总体特征和内部属性,明晰作为数字法学核心的算法的法理。在此基础上,凝聚数字法学的基本法理共识,构建并完善系统且逻辑自洽的数字法律制度,明确数据安全的优位性和核心性,划清网络空间各类公权力和个人权利之间的界限,并对算法进行全方位的规制,实现对网络空间从数字法理到相应制度的善治。The era of big data brings new risks,and the universalist rule of law order formed by the traditional concept of rule of law and its systematic institutional design is facing stern challenges.Due to the lack of research perspectives and research methods,as well as the lack of unified network digital legal support,existing research has failed to form an independent knowledge group with a common discourse foundation,which has fragmented the solution of problems related to cyberspace governance and manifested itself as an emergency governance model in practice.Based on the holistic cyberspace governance,we should form a community of digital law research,clarify the external overall characteristics and internal attributes of digital law as an emerging science of field law,and clarify the legal principle of algorithm as the core of digital law.On this basis,consolidate the basic legal consensus of digital law,build and improve a systematic and logically consistent digital legal system,clarify the superiority and core of data security,draw a clear boundary between various public powers and individual rights in cyberspace,and carry out all-round regulation of the algorithm to achieve good governance of cyberspace from digital jurisprudence to corresponding systems.
