体育产业高质量发展的法治保障研究--基于《中华人民共和国体育法》修订的思考

摘　　要：体育产业要实现高质量发展,离不开有力的法律保障。文中采用文献资料、逻辑分析等方法对《中华人民共和国体育法》新增体育产业章节进行了深入思考。研究认为:修订后的《中华人民共和国体育法》增加体育产业章节,实现了体育产业立法层面的突破,对推动群众体育、竞技体育和体育产业协调发展,扩大体育产品和服务供给,推动体育产业成为国民经济支柱性产业具有重大意义;修订后的《中华人民共和国体育法》明确了体育产业发展的定位和思路、明晰了体育产业的内容和体系、强调体育产业发展创新要素的培育、指明中国特色职业体育改革方向、支持区域体育产业协调发展;进一步推动体育产业高质量发展需要从体育市场规范发展、体育赛事活动健康发展、中国特色职业体育发展、社会力量投资体育产业、地方政府促进体育产业发展等方面完善法治保障。The legal safeguard is indispensable for the high-quality development of the sports industry.In this paper,the new chapter of the sports industry in“The Law of the People’s Republic of China on Physical Culture and Sports”has been deeply analyzed by means of literature review and logical analysis.The results showed that with the added new chapter in The Law of the People’s Republic of China on Physical Culture and Sports,the sports industry has achieved a legislation breakthrough.It is of great significance to promote the coordinated development of mass sports,competitive sports and the sports industry,expand the supply of sports products and services,and promote the sports industry to become a pillar industry of the national economy.The newly revised“The Law of the People’s Republic of China on Physical Culture and Sports”defines the orientation and thinking of the development of the sports industry,clarifies the content and system of the sports industry,emphasizes the cultivation of innovative elements for the sports industry,points out the direction of professional sports reform with Chinese characteristics,and supports the coordinated development of the regional sports industry;To further promote the high-quality development of the sports industry,it is necessary to improve the legal protection from the aspects of the standardized development of the sports market,the healthy development of sports events,the development of professional sports with Chinese characteristics,the investment of social forces in the sports industry,and the promotion of the development of the sports industry by local governments.
