故意毁坏财物罪的客观构成要件分析——兼谈拆除分时租赁汽车GPS装置行为

摘　　要：涉及分时租赁汽车的犯罪行为包括故意毁坏财物罪、盗窃罪等。故意毁坏财物罪保护的法益是财物的使用价值。毁坏行为是对财物一般效用的侵害。拆除分时租赁汽车GPS装置的行为可能构成不同犯罪形态的故意毁坏财物罪。故意毁坏财物罪、寻衅滋事罪与破坏生产经营罪可构成想象竞合。Crimes involving time-counting rental cars include vandalism,auto property theft and so on.The vandalism involving the legal interest is the property use value.The intentional destruction is the infringement upon the general utility of property.Dismantling the GPS device of time-counting rental car may constitute vandalism which appears in different criminal forms.The vandalism,public disturbance and the crime of destroying production and business operation can constitute imaginative concurrence.
