网络版权侵权投诉中合格通知的认定

摘　　要：作为“通知—删除”机制中的关键要素,侵权投诉通知在网络实践中被广泛应用。《民法典》第1195条对网络侵权中通知的要求仍较为原则性,不同的网络服务提供商对侵权投诉通知的要求存在较大差异。因此,在我国网络版权侵权语境下,对合格通知的判断标准有待进一步细化。此外,对通知合格性的判断还应当结合《信息网络传播权保护条例》等规定,并立足于著作权人与网络服务提供商的利益平衡。在具体个案审理过程中,应当从通知主体适格性、通知形式适格性及通知内容适格性等方面出发进行综合判定。As a key element of“notice-delete”mechanism,the infringement complaint notice is widely used in the network practice.With the requirement for Internet infringement notices relatively principled in Article 1195 of the Civil Code of PRC,various Internet service providers have diverse requirements for the infringement complaint notice.Therefore,the judgment standard of qualified notices in the context of network copyright infringement in China needs to be further refined.The judgment of the qualification of the notice should also be combined with the Regulations on the Protection of the Right of Information Network Communication,and be based on the balance of interests between copyright owners and network service providers.In the process of a specific case trial,a comprehensive judgment should be made from the suitability of the subject,form and content of the notice.
