体育规则法治化的积极效能与路径选择——以CUBA北大VS中国矿大争议事件为切入点

摘　　要：通过对2021年6月5日CUBA北京大学对阵中国矿业大学比赛争议的分析,引出对体育规则法治化问题的思考。认为体育规则作为体育领域的重要社会规范,对规范体育参与者行为、引导体育参与者及公众的道德观念、促进经济发展都发挥着重要作用。体育规则法治化则有利于形成更加完备的体育规则,提升体育规则权威性,并能促进竞技体育和全民健身协同发展。在依法治国的背景下,应通过法治基础上的体育自治指导体育规则设立,要明确体育规则冲突的法治化解决原则,以及通过充实体育法律体系和转变政府职能等方式,来推进体育规则法治化,为我国体育事业发展提供保障。Through the analysis of the dispute of the competition between CUBA Peking University and China University of Mining and Technology on June 5,2021,this paper leads to the thinking of the legalization of sports rules.As an important social norm in the field of sports,sports rules play an important role in standardizing the behavior of sports participants,guiding the moral concepts of sports participants and the public,and promoting economic development.The legalization of sports rules is conducive to the formation of more complete sports rules,improving the authority of sports rules,and promoting the coordinated development of competitive sports and national fitness.In the context of governing the country by law,the establishment of sports rules should be guided by sports autonomy on the basis of the rule of law,the principle of solving the conflict of sports rules by law should be clarified,and the legalization of sports rules should be promoted by enriching the sports legal system and transforming government functions,so as to provide guarantee for the development of sports in China.
