摘 要:2020年《基本医疗卫生与健康促进法》出台,将公益性作为基本原则之一。在此之前,党委领导下的院长负责制得以明确,推动公立医院加强党的建设,这一制度正是公益性原则的具体体现。然而在新制度落实过程中诸如决策主体转化不彻底、沟通机制不完善、民主决策机制不健全等问题凸显。将问题存在的原因归结于合法性阙如、制度认同缺乏、民主管理意识未深入人心。面对制度变革,公立医院应当处理好公益性与营利性、专业性与政治性、决策民主化与科学化几对关系,避免出现路径偏差。针对问题根源提出相应的建议举措,以期推进新制度的切实落地。In 2020,the Basic Medical Care and Health Promotion Law was introduced, making public welfare one of the basic principles. Prior to that, the system of presidential responsibility under the leadership of the Party committee was clarified to promote public hospitals to strengthen the construction of the Party, and this system is the concrete embodiment of the principle of public welfare. However, in the process of implementing the new system, problems such as incomplete transformation of decision-making subjects, imperfect communication mechanisms, and unsound democratic decision-making mechanisms have come to the fore. This paper attributed the problems to the lack of legitimacy, the lack of institutional identity, and the lack of democratic management awareness. In the face of institutional change, this paper argued that public hospitals should deal with the relationship between public welfare and profitability, professionalism and politics, and democratization and scientization of decision-making to avoid path deviation. It also puts forward corresponding suggestions and initiatives to address the root causes of the problems in order to promote the practical implementation of the new system.
