摘　　要：公布涉疫个人信息在疫情防控工作中发挥了重大作用,但是也需要平衡公开涉疫个人信息与个人信息保护之间的关系。在广泛收集调查问卷以及分析全国各直辖市、省会市(含自治区首府所在市,下同)公布方式的实证研究基础上,得出目前各城市公布涉疫个人信息的方式存在的问题:公布信息指向性太强、前后公布标准不一致、公布主体越权。在分析上述问题的基础上,提出可供各城市参考的最优公布模板,由县级以上地方人民政府卫生健康主管部门公布本行政区域的信息,提升相关规范的法律位阶,完善法律体系。The publication of epidemic-related personal information plays an important role in the effective prevention and timely prevention of the epidemic, but it also necessary to balance the relationship between the information publication and the protection of rights. On the basis of extensive questionnaire collection and empirical research on the analysis of the publication methods from centrally-administered municipalities and provincial capitals(including capitals of self-autonomous regions, same below) across the country, it is concluded that there are some problems in the current publication modes of some cities: the conflict between the public’s right to know and the individual’s right to privacy, the distinguishing standard of personal information are not clear. In addition, the sensitive information is improperly desensitized, the published information is too directional, and the publishing subject is ultra vires. Based on the analysis of the above-mentioned problems, we proposed an optimal publication template that can be used as a reference for each city. The health authorities of the local government at or above the county level will publish the information of the administrative region, improve the legal status of relevant regulations, and improve the legal system.
