摘　　要：医疗美容机构超出登记范围开展诊疗活动存在监管难点,本案中关于超出登记范围开展诊疗活动的认定存在争议,导致该案件经历3次申请延期作出行政处罚决定、召开卫生行政处罚听证会、行政复议等过程,最终给予该医疗美容机构罚款人民币3 000元并吊销《医疗机构执业许可证》的行政处罚。结合该起案件论述医疗美容机构超出登记范围开展诊疗活动的认定过程,探讨解决医疗美容机构超出登记范围开展诊疗活动问题的方法。It is difficult to supervise cosmetic surgery clinics if they carry out diagnosis and treatment activities beyond the scope of registration. In this case, there were disputes on the identification of diagnosis and treatment activities beyond the scope of registration, which led to three applications for postponing the decision of administrative punishment, holding hearings on health administrative punishment, administrative reconsideration and other processes in this case. In the end, the cosmetic surgery clinic was fined RMB 3,000 yuan and the " Practice License of Medical Institution was revoked. Based on this case, this paper discussed the identification process of the cosmetic surgery clinic carrying out clinical activities beyond the scope of registration, and discussed the methods to solve the problem of cosmetic surgery clinics carrying out clinical activities beyond the scope of registration.
