公安机关侦查人员人数的重构

摘　　要：虽然法律规定侦查行为应由2名以上侦查人员进行,但是由于案多人少的客观现实,在实务中很难做到每种侦查行为都由2名以上侦查人员进行。侦查人员人数涉及的核心问题是侦查权主体理论和保证侦查行为的真实性,随着同步录音录像技术的应用、辅警队伍的规范化以及认罪认罚从宽制度的实施,侦查人员人数的重构具备了现实基础。应根据强制性侦查行为与任意性侦查行为的区别,规定不同的侦查人员人数要求,强制性侦查行为继续适用侦查人员不得少于2人的规定,任意性侦查行为可由不得少于2人的侦查人员或者侦查人员与辅警进行。这种侦查人员人数安排也能够实现侦查人员人数规定的立法目的。Although the law stipulates that the act of investigation should be carried out by more than two police investigators,it is difficult in practice due to the reality of too many cases and limited police force.The core considerations involved in the number of investigators are the theory about the subject of investigation and ensuring the credibility of the investigation behavior.With the application of synchronous audio and video recording technology,the standardization of auxiliary police teams and the implementation of the lenient punishment system for those who admit their guilt and accept their punishment,the reconstruction of the number of investigators has a realistic basis.According to the differences between compulsory investigation and routine investigation,different numbers of police investigators shall be stipulated.compulsory investigations shall follow the stipulation of having no less than 2police investigators,whileroutine investigations may be carried out by no less than 2 police investigators or one police investigator plusone auxiliary police officer.This arrangement of the number of investigators can also meet the legislative purposesabout the stipulation of the number of investigators.
