论大数据视域下的侦查情势

摘　　要：大数据应用于侦查,存在忽视应用场景,直接将大数据套用至侦查的错误倾向。为解决此问题,通过大数据与侦查情势概念特征分析,梳理出构成模式均呈现运动开放状态、内部要素均表征相近相联关系、目标取向均追求预测研判功能等三个主要契合点,以此搭建应用场景。重点阐释大数据提升侦查主体认知能力,帮助获取更多侦查情势信息的作用,以及大数据为侦查情势分析提供的先进方法。进而提出运行路径中借助数据库和知识图谱构建,将侦查理论和侦查模式融入大数据应用的思路,借此解决大数据和侦查“两张皮”问题,确保侦查人员在大数据运用中的主体地位。最后就大数据在侦查情势中的预测作用提出存疑思考及辅助作用分析。When big data is applied to investigation,there is a wrong tendency to ignore application scenarios and directly apply big data to investigation.In order to solve this problem,through the analysis of big data and investigation concept characteristics,three main convergence points are sorted out,including composition mode showing motion open state,internal factors representing similar joint relationship,and target orientation pursuing prediction and judgment function,so as to build application scenarios.With the analysis of meeting point as the carrier,this paper focuses on the role of big data in improving the cognitive ability of investigation subjects and helping to obtain more information of investigation situation,as well as the advanced methods provided by big data for investigation situation analysis.Then,based on the analysis of application scenarios and functions,this paper proposes the idea of integrating investigation theory into big data application with the help of database and knowledge map construction in the operation path,so as to solve the problem of"two skins"of big data and investigation,and ensure the principal position of investigators in the application of big data.Finally,the doubtful thinking and auxiliary role analysis on the prediction role of big data in the investigation situation are proposed.
