新时代全民健身的法律激励:文本检视、理念阐释及制度革新

摘　　要：我国现行的全民健身相关法律法规中存在较多具有激励意义的规定并起到了一定的激励作用。站在新时代这一历史方位上,深入实施“全民健身”国家战略和“健康中国”国家战略,助力体育强国建设,其在激励对象、激励范围、激励措施等方面还存在一些问题亟待改进。因此,应当秉持人本主义、实质正义、社会本位的制度革新理念,在激励对象明晰、激励范围扩大、激励措施细化3个方面进行具体的制度革新,从而不断夯实全民健身“中国之治”的基座,切实保障人民群众的健身权益,让全民健身事业取得更多的改革发展成果并更公平地惠及广大民众。同时,为打造健康中国,实现健康强国,为构建人类卫生健康共同体提供中国智慧和中国方案。There are many provisions of legal incentives in China’s current national fitness laws and regulations,which play a certain incentive role.However,in the new era,there are still some problems in the incentive object,incentive scope and incentive measures in terms of fully implementing the national strategies of“national fitness”and“Healthy China”to help develop China into a leading sporting nation.Therefore,we should uphold the system innovation concepts of humanism,substantive justice,and social standard.At the same time,we need to carry out specific system innovation in three aspects:clear incentive objects,expanded incentive scope and detailed incentive measures,so as to continuously consolidate the foundation of the“rule of China”of national fitness,protect the fitness rights and interests of the people,and allow the achievements of the reform and development of the national fitness cause to benefit everyone more equally.At the same time,it provides Chinese wisdom and Chinese solutions for building a healthy China,developing a healthy and powerful nation,and building a community of human health.
