摘　　要：电子证据是打击网络赌博犯罪的最有效证据,网络赌博犯罪的跨国界发展,使跨境电子取证成为我国打击网络赌博犯罪的重要取证方式。基于国际刑事司法协助模式的电子取证难以发挥效力,单向取证模式也存在一定弊端。因此,我国需要对内完善国内法律规范,对外发挥我国法律的域外效力并加强国际合作,同时探索侦查机关向网络服务提供者直接取证模式,加强侦查人员能力建设,以期构建网络赌博犯罪跨境电子取证的便捷、高效模式。Electronic evidence is the most effective in combating online gambling crimes.The cross-border development of online gambling crimes has made cross-border e-discovery an important forensic way to combat online gambling crimes in China.Based on the international criminal judicial assistance model of e-discovery is difficult to play effective,one-way forensic model also has certain drawbacks.Therefore,China needs to improve domestic legal norms internally,exert the extraterritorial effects of Chinese laws and strengthen international cooperation,while exploring the direct forensic mode of investigating authorities to network service providers and strengthening the capacity of investigators,so as to build a convenient and efficient mode of cross-border e-discovery of online gambling crimes.
