摘  要:气候变化与生物多样性之间具有紧密的耦合关系,实现应对气候变化与生物多样性保护的协同增效已经成为国际和国内环境治理的重要任务。基于生态系统服务的规制路径可以实现固碳增汇和保护生物多样性的协同增效。鉴于应对气候变化与生物多样性保护任务分属于两个独立的规制体系,还存在着生态系统碳汇价值未得到法律的重视、适应性制度与生物多样性保护制度不够融合、风险权衡机制与协同规制机制未建立等问题,本文提出了基于生态系统服务为路径的规制分析框架。以协同规制理论为指引,分析了协同规制存在的问题后,本文提出协调两个规制体系的价值目标、完善碳汇制度、建立风险权衡机制和国际国内协同规制机制的对策建议。Achieving synery between addressing climate change and conserving biodiversity has become an important task for domestic and international environmental governance.Close coupling relationship exists between climate change and biodiversit Regulatory pathways based on eco-system services can achieve synergies in carbon sequestration and biodiversity conservation.Since addressing climate change and conserving biodiversity belong to two independent regulatory systems and there are still some problems including the lack of legal attention on the value of ecosystem carbon sinks,insufficient integration between the adaptive system and the biodiversity conservation system and no establishment on risk balance and collaborative regulation mechanism,this paper proposes an eco-system service-based regulatory analysis framework and analyzes the existing problems of collaborative regulation under the guidance of collaborative regulation theory.After that,it corrspondingly puts forward countermeasures and suggestions to coordinate the value goal of the two regulatory systems,improve the rules of carbon sink,and establish a risk balance mechanism and a domestic and international coordinated regulatory mechanism.
