摘 要:节约资源是指民事主体在其民事活动中应当最大限度地降低资源消耗的数量,以最少的资源消耗,获取最大的经济效益和社会效益,实现资源效益的最优化和最大化;该义务具有强烈的伦理性和浓厚的传统性,系基本义务、普遍义务。其价值和功能主要体现在:贯彻实施节约资源之基本国策,适应我国国民经济和社会发展需要,履行我国在国际法上的节约资源义务,遵守生态系统规律的客观要求。其主要内容包括资源的适度利用、合理开发和合理利用。为保障义务之履行,党政机关应当率先垂范,此外须建立健全相应的宏观调控机制、监督机制和责任机制。Resource saving means that the civil subject should minimize the amount of resources consumption,and obtain the maximum economic and social benefits by minimum resource consumption in its civil activities.Such an the obligation has a strong ethical and traditional nature,and it is also a basic and general obligation.Its value and functions are mainly reflected in the implementation of the basic national policy of resource conservation,which meets the needs of China’s national economic and social development,fulfills China’s obligation of resource conservation under international law,and abides by the objective requirements of ecosystem laws.Its main contents include the appropriate utilization of resources,reasonable development and reasonable utilization.In order to ensure the performance of their obligations,the Party and government organs should take the lead in setting an example,in addition to establishing and improving the corresponding macro-control mechanism,supervision mechanism and responsibility mechanism.
