新时代党政联合行文之法律性质的认定标准研究

摘　　要：在中国共产党领导人民管党治国的实践中,基于党的领导地位,党的机关和行政机关往往采取“联合行文”的方式实现既定的治理目标,从而产生了诸多“党政联合行文”。进入新时代,伴随着党的全面领导的加强,党政联合行文现象愈发普遍,且逐渐彰显出无可替代的制度优势和独特治理效能。党政联合行文在实践中遭遇的困境,源于对其法律性质的认识不清,并由此引发了理论上的争议。为准确认定党政联合行文的法律性质,需要构建起双层梯级的认定标准体系,即首先通过“具体与抽象”的“一级认定标准”将党政联合行文区分为“具体型党政联合行文”和“抽象型党政联合行文”,由此将“具体型党政联合行文”认定为体现“党的意志”的具体行政决定。而对于“抽象型党政联合行文”,需要通过“形式与实质”的“二级认定标准”进行再次判断,从而精准认定一个党政联合行文的具体法律属性。In the practice of Chinese Communist leading the people to govern the party and the country,based on the leadership of the party,party organs and administrative organs often adopt the method of“joint writing”to achieve the established governance goals,resulting in many“joint writings between the party and the government”.Entering the new era,along with the strengthening of the party’s overall leadership,the phenomenon of party-government joint writing has become more and more common,and has gradually demonstrated irreplaceable institutional advantages and unique governance effectiveness.The difficulties encountered in the practice of the joint writing of the party and the government stem from the unclear understanding of its legal nature,which has caused theoretical disputes.In order to accurately identify the legal nature of the party-government joint writing,it is necessary to build a two-tiered identification standard system,that is,first,through the“first-level identification standard”of“concrete VS abstract”,the party-government joint writing is divided into“concrete party-government joint”.Therefore,the“concrete party-government joint writing”is identified as a specific administrative regulation that embodies the“will of party”.For“abstract party-government joint writing”,it needs to be judged again through the“second-level identification standard”of“form vs substance”,thus we can accurately identify the specific legal attributes of a party-government joint writing.
