论党内监督执纪中违纪线索移送与处置的应然限度——以国家监察的处置衔接为视角

摘　　要：监察立案与党纪审查因“党政合署”而存在线索处置上的程序重合,党纪审查部门对应的违纪线索处置权限,可作为职务违法和职务犯罪监察调查的前置。在纪法衔接过程中,以党内法规为指引的党纪审查与以《监察法》为依据的监察调查在线索的取得方式、移送和管理上应作必要界分,明晰不同案件在党纪审查与监察调查阶段的内部分工差异。以比例原则为考量,违纪线索的处置权限与规制效果应符合程序相称性原理。从线索来源的信息评估层面出发,违纪线索的评估应建构科学合理的量化体系。对于违纪线索的处置应依照情报要素界分线索来源可靠性的不同类型,明确党内监督保障法规的执行依据。对于违法犯罪线索的处置,党纪部门在参考线索评估量化结果的同时应辨明“移送处置”与“暂存待查”的适用界限。Because of the“party and government offices”,the procedures of handling clues overlap between the case filing and the party discipline examination,and the authority of handling disciplinary clues corresponding to the party discipline examination department can be used as the front of the supervision and investigation of duty violations and duty crimes.In the process of convergence between discipline and law,the party discipline review guided by the party’s internal laws and regulations and the supervision investigation based on the Supervision Law should make necessary demarcation in the way of obtaining clues,transferring and managing,and clarify the differences of internal division of labor between different cases in the stage of party discipline review and supervision investigation.Taking the principle of proportionality as consideration,the handling authority and regulation effect of disciplinary clues should conform to the principle of procedural proportionality.From the information evaluation level of clue sources,the evaluation of disciplinary clues should construct a scientific and reasonable quantitative system.For the disposition of disciplinary clues,different types of clues’source reliability should be classified according to intelligence elements,and the enforcement basis of the inner-party supervision and guarantee laws and regulations should be made clear.For the disposal of illegal and criminal clues,the party discipline departments should identify the applicable boundary between“transfer for disposal”and“temporary storage for investigation”while evaluating the quantitative results with reference to clues.
