网络盗版正版化对短视频著作权侵权问题的启示

摘　　要：短视频著作权侵权与网络盗版存在一定的相似性,合理使用、责任控制以及版权补偿金制度如同不能解决网络盗版问题一样,也不能解决短视频著作权侵权问题。而解决网络盗版问题的市场路径几乎成为短视频著作权侵权问题的唯一解决办法。欧盟以立法的方式迫使正版市场的形成,实质上提高了平台责任,其可能不仅不利于著作权人而且可能会限制竞争以及言论自由。而我国经网络盗版正版化所证实的以知识产权行政保护促进正版市场形成的路径便成为合理选择,以平台与著作权人双方协商为主导,行政机关协调二者化解矛盾为辅,最终形成一定比例的正版授权,加之自愿过滤机制,辅以“通知-删除规则”同时配合上传者权利保护机制的短视频正版化路径。There are some similarities between short video copyright infringement and online piracy.Reasonable use,responsibility control,legislative control and copyright compensation system can not solve the problem in both areas.The market path to online piracy seems to be the only way to short video copyright infringement.EU promotes the legal copy market by means of legislation,which essentially imposes the responsibility on platforms.It may not only be detrimental to copyright owners,but also restrict competition and freedom of speech.In China,the path of promoting the legal copy market with the administrative protection of intellectual property rights has become a reasonable choice.It is dominated by the negotiation between the platform and the copyright owner,supplemented by the coordination between the administrative bodies to resolve the contradiction.Finally a short video legalization path will be produced,featured by"a certain proportion of copy authorization,with the voluntary filtering mechanism",supplemented by the"notice—deletion rules",coupled with protection mechanism of the uploader.
