摘　　要：伴随着我国农业经济的发展,农民专业合作社逐步兴起,但其发展缓慢且后劲不足。文章从农民专业合作社成员资格及立法现状入手,着重分析农民专业合作社成员资格界定的法理基础,进而构建农民专业合作社成员资格界定中的开放与限制。With the development of China’s agricultural economy,farmers’professional cooperatives gradually rise,but its development is slow and lack of momentum.Starting from the elaboration of member-ship and legislation status of farmers’professional cooperatives,this paper focuses on the analysis of the le-gal basis for the definition of membership of farmers’professional cooperatives,and then constructs the opening and restriction in the definition of membership of farmers’professional cooperatives.
