摘　　要：由于对人民警察防卫权性质不同的理解,对警察防卫权正当性基础出现了不同学说的争议。马克思主义“人本”思想观点下人的双重属性对于解释警察防卫权性质也具有合理性。在此基础上,明确警察防卫权的个人防卫和职务防卫的双重属性,分析警察防卫权外在属性和根本属性的统一性和警察防卫权的特点,不仅有利于对解决警察防卫权性质争议和立法规定的笼统化问题,而且在当前暴力袭警事件的愈发严重的背景下,为人民警察正当防卫权法定化和类型化的展开具有重要意义,最终实现对人民警察正当防卫权的刑法保护。Because of the different understandings of the nature of the people’s police defense right,there is a dispute about the theoretical basis of the legitimacy of the police defense right.The dual attribute of human beings under the Marxist“human-oriented”thought is also reasonable for explaining the nature of police defense right.On this basis,it is beneficial to solve the generalization problem of the dispute of the nature of police defense right and legislative provisions,as well as to carry out the legalization and categorization of the people’s police’s right of self-defense under the background of the increasingly serious violent attack on police,and finally realize the criminal law protection of the people’s police’s right to self-defense.
