摘 要:当前,我国涉征地纠纷案件仍呈现高发态势,受制于纠纷当事人日益增长的司法需求与司法资源的有限供给、行政权的惯性张力与司法权的张力不足及效力偏低、征地纠纷的复杂性与司法审查手段的有限性等结构性矛盾,运用司法手段解决征地纠纷还存在诸多困境。这意味着传统中立性、被动性司法已难以满足人民群众的司法期待,以合意、协作为特征的开放型司法模式证明更符合纠纷解决的需求。质言之,完善征地纠纷解决多元化平台,整合诉讼与非诉讼力量,强化司法审查,维持权利保障与权力制约之平衡,才能实质性化解征地纠纷。At present,the cases of land expropriation disputes in China are still showing a high incidence trend.Subject to structural contradictions between the increasing demand for justice from the related parties and the limited supply of the judicial resources,between the conventional arrogance and resistance of the executive power and the impotence and deficiency of the judicial power,between the complexity of land expropriations and the limitation of the judicial review methods etc.,there exist a lot of difficulties and dilemmas to resolve land expropriation disputes in a judicial way.This means that the current judiciary characterized by neutrality and passivity is hard to satisfy the public expectation of the justice,while the open judicial operation characteristic of consensus and cooperation is a more suitable solution of these disputes,which has been already proved by facts and practice.Frankly speaking,we have to improve the multiple dispute resolution mechanism related to land expropriations,promote the integration of litigation and non-litigation forces,intensify the judicial review and maintain the balance of right protection and power restriction so as to achieve the virtual solution of these disputes.
