摘　　要：自2018年向台湾同胞制发中国台湾居民居住证以来,国家出台相关配套的政策法规,保障了持证台胞在大陆工作、学习和生活上的方方面面切实享受到了与大陆居民同等待遇。当前对中国台湾居民居住证适用情况进行实证分析,是明晰其性质与作用、发现适用实践中的缺漏、继续推动落实对台同等待遇战略的必要步骤。本文在阐述中国台湾居民居住证的适用依据及性质的基础上,对其所赋予中国台湾居民的同等待遇内容进行评析,并通过对公开生效的裁判文书的整理与分析,总结归纳出中国台湾居民居住证在涉台民事审判中的适用情况及主要作用,从而为今后进一步完善中国台湾居民居住证的适用提供理论和实践支撑。Since the issuance of residence permits for Taiwan residents in 2018,the state has issued relevant supporting policies and regulations,enabling Taiwan compatriots with the permit to enjoy the equal treatment as mainland residents in all aspects of work,study and life in the mainland.An empirical analysis of the current application of the residence permits for Taiwan residents is a necessary step to clarify its nature and function,discover the gaps in the application practice,and continue to promote the implementation of the strategy of equal treatment to Taiwan.On the basis of expounding the applicable basis and nature,this article evaluates and analyzes the content of equal treatment given to Taiwan residents,and summarizes the application and main role of Taiwan resident's residence permit in Taiwan related civil trials through the sorting and analysis of the effective and public judgment documents,so as to provide theoretical and practical support for further improving of its application in the future.
