RCEP知识产权章节与TRIPS协定的关系:基于条约法的分析

摘　　要：RCEP知识产权章节,是WTO 164个成员中的15个成员在TRIPS协定许可加约束的条件下,对TRIPS协定进行修改且仅适用于它们自己的“协定”,由此产生的知识产权规则超出TRIPS协定的要求,与TRIPS协定构成相互独立的“并存”关系。RCEP知识产权章节对TRIPS协定的修改,沿用了TRIPS协定曾经采用的造法技术,通过“提示条款号码”和“复制条款内容”的方式,将TRIPS协定的部分条款纳入其中,使其成为自身的组成部分;RCEP缔约方依据此类纳入条款所享有的权利和承担的义务,已不是TRIPS协定下的权利和义务,而是RCEP知识产权章节下的权利和义务。根据TRIPS协定和RCEP知识产权章节冲突条款的规定,当RCEP知识产权章节的规定与TRIPS协定的规定发生冲突时,后者居于被遵从和优先适用的地位。在区域贸易协定已成为国际知识产权造法重要平台的今天,正确认识和把握RCEP知识产权章节与TRIPS协定的关系,其意义已超出它所涉的主题范围,可能为后TRIPS时代国际知识产权制度的有效实施和协同发展提供有益的启示和参照。The intellectual property chapters of the RCEP Agreement refers to an“agreement”reached by 15 of the 164 WTO members through modifying the TRIPS Agreement that applies only to these 15 members under the conditions permitted and restricted by TRIPS Agreement.The resulting Intellectual Property rules exceed the requirements of TRIPS Agreement and constitute a mutually independent“co-existence”relationship with the TRIPS Agreement.The amendment to the TRIPS Agreement in the intellectual property chapters of the RCEP Agreement adopts the law-making technology used in the TRIPS Agreement and incorporates some provisions of the TRIPS Agreement into it by means of“indicating the number of provisions”and“copying the contents of the provisions”,making them a part of the RCEP Agreement.The rights and obligations of RCEP parties under such inclusion clauses are no longer rights and obligations under the TRIPS Agreement,but rights and obligations under the intellectual property chapters of the RCEP Agreement.In accordance with the conflicting clauses of the TRIPS Agreement and the intellectual property chapters of the RCEP Agreement,when the provisions of the intellectual property chapters of the RCEP Agreement conflict with the provisions of the TRIPS Agreement,the latter are subject to dominant and priority application.At present,regional trade agreements has become an important platform for international intellectual property law-making,and the significance of correctly understanding and grasping the relationship between the intellectual property chapters of the RCEP Agreement and the TRIPS Agreement has gone beyond the scope of its subject matter,which may provide useful enlightenment and reference for the effective implementation and coordinated development of international intellectual property system in the post-TRIPS era.
