区分自然资源资产所有者权利与管理者权力——以矿产资源开发为例的产权“二元结构”分析

摘　　要：自然资源管理制度改革的总要求为:区分自然资源资产所有者权利与管理者权力。在体制上,同一管理者对同一资源行使所有权与监管权;在制度上,双重身份的关键是区分管理的权利与权力。正确处理市场与政府的关系,在于“区分”两者而不是“分开”两者,才能防止政府管理的缺位与越位。区分两者关系的难点在于:从理论与制度上进行分辨并做出判断。为此,构建产权状态“二元结构”理论模型,并循着《宪法》第9条规定关于自然资源“国家所有”与“合理利用”的产权关系,以矿产资源资产为例进行实证分析。“二元结构”的静态归属产权与动态利用产权,两者各自独立并分别明确市场与政府职能的分工:资源归属产权属于绝对性所有者权利,由市场决定配置;资源利用产权接受政府管制,由政府行使管理者权力。The general requirements for the reform of natural resources system are:to distinguish the owner right of natural resources assets and the right of managers.In the system,the same administrator exercises the ownership and supervision over the same resource.Institutionally,the key to dual identity is to distinguish between the managerial right and the power.The correct handling of the relationship between the market and the government lies in"distinguishing"rather than"separating",so as to prevent the absence and offside of government management.The difficulty of distinguishing the relationship between the two lies in:to distinguish and make a judgment from the theory and the system.Therefore,the theoretical model of"dual structure"of property rights is constructed,and the property rights relationship between"state ownership"and"rational utilization"of natural resources is based on Article 9 of the Constitution,taking mineral resource assets as an example for empirical analysis.The static ownership property right and dynamic utilization property right of"dual structure"are independent,clarifying the division of market and government functions:resource ownership property right is an absolute owner’s right,determined by the market and"insulated"from the government public power;resource utilization property right must accept socialized government control,and the government must exercise the management power.
