内地与澳门联合实施毒品犯罪控制下交付问题探究

摘　　要：随着内地与澳门之间经济文化交流的加深,网络、通信技术、物流的迅速发展及《粤港澳大湾区发展规划纲要》的实施,日益变化的跨境毒品犯罪为内地与澳门之间毒品犯罪打击带来新挑战。建立在充分的风险分析和评估下的控制下交付,可以有效实现对跨境毒品犯罪的监控,查出涉及该犯罪链条的犯罪组织及幕后主谋,实现全案侦破。内地与澳门联合实施毒品犯罪控制下交付,有法律、机制、框架协议等基础,有合作共识基础,有可供借鉴的实践经验,当然也存在着制约因素。为此,要对联合控制下交付的核心问题做出安排,监控实施过程,适时实施抓捕,收集保全证据,以实现控制下交付的预期目的。With the deepening of economic and cultural exchanges between the mainland and Macao,the rapid development of network,communication technology and logistics and the implementation of the Outline Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area,the ever-changing cross-border drug crimes have brought new challenges to the fight against drug crimes between the mainland and Macao.The controlled delivery under full risk analysis and evaluation can effectively monitor the cross-border drug crimes,find out the criminal organizations and the masterminds involved in the criminal chain and realize the whole case detection.There are laws,mechanisms and framework agreements for the joint implementation of controlled delivery of drug crimes between the mainland and Macao,as well as the basis of cooperation consensus,practical experience for reference,and of course,constraints.Therefore,it is necessary to make arrangements for the core issues of joint controlled delivery,monitor the implementation process,arrest in due course,and collect preservation evidence to achieve the expected purpose of controlled delivery.
