摘　　要：第二次世界大战后,国际社会就如何构建投资领域的多边规则进行了长久的尝试,但碍于综合性和特定领域规则的困境与局限性而不了了之。进入21世纪,投资治理体系碎片化和可持续发展目标加速国际投资体制改革,投资便利化作为规范东道国监管、降低投资者实际障碍的重要举措,在国家、区域和多边层面都被给予了高度重视。南北国家最终能否在投资便利化议题上达成共识,填补国际投资规则的系统性空白?笔者通过系统梳理投资便利化产生的背景与国际社会结构化讨论进程,基于投资便利化的基本原则与典型措施构建指标体系,评估全球投资便利化的发展现状。投资便利化是全球投资治理规则中最容易达成共识的部分,规避了以往多边投资规则的核心问题,仅强调在决策阶段增加政策透明度、执行阶段简化行政流程和多边联动以加强国际合作与能力建设,将南北国家在边境问题上的对立转换为准入后的监管合作。当前,全球投资便利化水平呈上升态势,但仍须加快指导原则向文本协定的过渡。After the Second World War,the international community has made a long attempt on how to construct multilateral investment rules,but it has not been solved due to the difficulties and limitations of comprehensive and specific rules. Entering the 21st century,the fragmentation of the investment governance and the goal of sustainable development have accelerated the reform of the international investment system. As an important measure to standardize the supervision of the host country and reduce the actual obstacles of investors,investment facilitation has been highly valued at the national,regional and multilateral levels. Can the north and South countries finally reach a consensus on the issue of investment facilitation and fill the systematic gap in international investment rules? By systematically combing the background and structured discussion process of the international communityof investment facilitation,an index system is constructed based on the basic principles and typical measures to evaluate the development of global investment facilitation. This paper holds that investment facilitation is the easiest part of the global investment governance rules to reach a consensus,avoiding the core issues of the previous multilateral investment rules,convert the opposition between North and South countries on the border issue into post access regulatory cooperation. At present,the level of global investment facilitation is on the rise,but the transition from guiding principles to text agreements still needs to be accelerated.
