加付赔偿金制度行政前置程序之检讨——以《劳动合同法》第85条为中心

摘  要:出于缺少强制执行权等原因,劳动监察机关向用人单位发出责令支付行政文书困难,致使劳动者的加付赔偿金请求大多得不到法院的支持。加付赔偿金条款处于“睡眠状态”,立法目的完全落空。劳动者获得加付赔偿的实体基础在于用人单位违反劳动基准强制规定未及时支付工资报酬,行政程序处理只是一种程序性的安排,不能因为程序上的瑕疵而否认劳动者的实体权利。应对加付赔偿金条件作出符合立法目的理解,只要用人单位有未按时支付劳动报酬的违法行为,劳动者就可获得加付赔偿金。为了提升纠纷解决效率,需明确加付赔偿金适用“一裁终局”,准确界定“逾期不支付”期限,提升劳动者权益保障水平。Due to the lack of enforcement power and other reasons, it is difficult for the labor supervision organ to issue an administrative document ordering the employer to pay, so that most of the workers’ claims for additional compensation cannot be supported by the court. The additional compensation clause is in a“sleep state”,and the legislative purpose has completely failed. The substantive basis for workers to obtain additional compensation is that employers fail to pay wages and remuneration in time in violation of the mandatory provisions of labor standards. The handling of administrative procedures is only a procedural arrangement, and workers’ substantive rights cannot be denied because of procedural defects. The conditions for additional compensation should be understood in line with the legislative purpose. As long as the employer fails to pay labor remuneration on time, the worker can receive additional compensation. In order to improve the efficiency of dispute resolution, it is necessary to clarify that the“final decision”applies to the additional compensation, accurately define the period of“overdue non-payment”,and improve the protection level of workers’ rights and interests.
