论非国家工作人员贪污贿赂定罪数额标准的重大修改——新《立案追诉标准(二)》评析

摘　　要：最高人民检察院、公安部2022年4月29日联合发布的新《立案追诉标准(二)》,对非国家工作人员贪污贿赂犯罪立案追诉标准作出了重大修改,即非国家工作人员与国家工作人员贪污贿赂罪的定罪数额采用了相同的标准。立案标准就是定罪标准,立案标准的下调是对“两高”《解释》所规定的过高定罪标准的纠偏,有利于体现立法精神,有助于实现平等保护原则和刑法结构的合理化。新《立案追诉标准(二)》只能适用于《刑法修正案(十一)》实施之后的非国家工作人员贪污贿赂犯罪行为,对于2021年3月1日之前实施的非国家工作人员贪污贿赂犯罪不具有溯及力。对于根据1997年《刑法》构成犯罪,但“两高”《解释》已不认为是犯罪的案件,新《立案追诉标准(二)》实施后不能再追诉。On April 29,2022,the Supreme People’s Procuratorate and the Ministry of Public Security jointly issued the new Standards for Filing and Prosecution(II),which made significant changes concerning the standards for filing and prosecution of corruption and bribery crimes by non-state staff.That is,the same standard has been adopted in the conviction amount of corruption and bribery crimes by non-state and state staff.The standard of filing a case is the standard of conviction.The lowering of the standard of filing a case is the correction of the excessive standard of conviction stipulated in Interpretation of the Supreme People’s Court and the Supreme People’s Procuratorate,which helps embody the spirit of legislation and realize the principle of equal protection and the rationalization of structure of criminal law.The new Standards for Filing and Prosecution(II)can only be applied to crimes of corruption and bribery committed by non-state staff after the implementation of the Criminal Law Amendment(11).Corruption and bribery crimes committed by non-state staff before March 1,2021 are not retroactive.For those cases which constitute a crime in accordance with 1997 Criminal Law but are not considered as a crime according to Interpretation,they can not be prosecuted after the implementation of the new Standards for Filing and Prosecution(II).
