摘　　要：我国农村土地管理制度改革的过程也是农村土地管理法治理念形成的过程。新《土地管理法》的实施,从集体经营性建设用地入市、征地程序和范围、宅基地“三权分置”等方面,赋予了农民更多的土地权益,同时让农民的权益得到更好的法律保障,我国农村土地管理制度改革也随之进入了深水区。本文梳理了农村土地管理制度的改革进程,从“三块地”改革的思路出发,分析了农村土地管理制度改革中法治困境,从法治思维和法治实践的角度提出了完善农村土地管理制度改革的路径,进一步提高农村土地管理制度改革的法治化水平,为推进我国农村土地管理制度法治化进程提供参考。China's rural land management system reform process is also the process of the formation of rural land management concept of the rule of law.The implementation of the new"land management law"endows farmers with more land rights and i nterests from the following aspects:the entry of collective construction land into the market,the procedure and scope of land expropriation,and the"separation of three rights"of homestead.At the same time,farmers'rights and interests are better protected by law.The reform of China's rural land management system has also entered the deepen area.This paper combs the reform process of rural land management system,starting from the idea of"three pieces of land"reform,analyzes the dilemma of rule of law in the reform of rural land management system,and puts forward the path to improve the reform of rural land management system from the perspective of legal thinking and legal practice,so as to further improve the legal level of rural land management system reform,It provides a reference for promoting the legalization of rural land management system in China.
