检察官客观义务的实践化探析

摘　　要：检察官客观义务不仅未因目前的司法制度改革而失却其现实性,而且具有从理论研究进一步走向实践化的现实需求。为促进检察官客观义务现实化,应当设立检察官客观义务现实化的判断标准并推动检察官客观义务履行的制度优化。前者的程序性内容包括检察官对控辩双方意见的倾听、检察官秉持中立的立场审视控辩双方提交的证据以及证据证明的案件事实、检察官以中立的立场审视案件的法律适用。实体性内容包括对控辩双方意见的审视与回应、对依法辩护的辩护律师予以必要的尊重、客观独立依法实施诉讼行为。后者则包括设置帮助检察官排除外来压力履行客观义务的机制,杜绝检察官基于维护自身利益的异地管辖机制,约束检察官履行客观义务的内在机制。The objective obligation of prosecutors not only has not lost its reality due to the current reform of the judicial system,but also has the practical need to further move from theoretical research to practice.In order to promote the realization of Prosecutors’objective obligations,we should set up the judgment standard of the realization of Prosecutors’objective obligations and promote the optimization of the system of Prosecutors’objective obligations.The procedural content of the former includes the prosecutor’s listening to the opinions of the prosecution and the defense,the prosecutor’s examination of the evidence submitted by the prosecution and the defense and the facts of the case proved by the evidence in a neutral position,and the prosecutor’s examination of the application of law in the case in a neutral position.The substantive content includes the examination and response to the opinions of the prosecution and the defense,the necessary respect for the defense lawyers defending according to law,and the objective and independent implementation of litigation according to law.The latter includes setting up a mechanism to help prosecutors eliminate external pressure to perform their objective obligations,eliminating the remote jurisdiction mechanism based on safeguarding their own interests,and the internal mechanism to restrict prosecutors to perform their objective obligations.
