摘　　要：违法事实明晰、主体认定准确是行政处罚合法有效的关键。作者通过分析一起个体工商户卫生行政处罚案件,探讨个体工商户经营者变更对卫生行政处罚主体认定、违法事实认定可能产生的影响,为同行在执法实践中提供参考。Clear illegal facts and accurate identification of the subject are the key to legal and effective administrative penalty.By analyzing a case of health administrative penalty of individual business,the author discusses the possible influence of the change of individual business operators on the identification of the subject of health administrative penalty as well as the identification of illegal facts,hoping to provide peers with some reference for the specific law enforcement practice.
