摘　　要：人民调解制度是我国社会治理创新的重要政法战略之一。从国家治理技术现代性变革的视角看,其得以成功运转所依托的调解技艺实践是决定人民调解能否顺利实现预期治理目标和价值追求的实践理性之维。调解技艺实践附着于年龄、阅历、符号资本等特定要素构筑相应的社会信任机制,进而借助“地方性知识”、法律能动主义、修辞策略等解纷技艺的展开,有机整合情、理、法,充分落实实质理性,有效实现“案结事了人和”。在新时代,与城市化、工商化、陌生化的社会转型进程相适应,人民调解制度的技艺实践出现了法治化、专业化、品牌化的变迁与创新。调解技艺实践考所揭示的人民调解制度的运行逻辑,是对这一作为“东方经验”典型代表的解纷之道的实践理性意涵之解读,有助于进一步推动基层治理机制的创新和国家治理技术的优化。The people’s mediation system is one of the important political and legal strategies for social governance innovation in China. From the perspective of the modernization of national governance technology, the practice of mediation skills on which mediation system can successfully operate is the dimension of practical rationality that determines whether people’s mediation achieve the expected governance goals and value pursuits. The practice of mediation skills is attached to specific elements such as age, experience and symbolic capital, thus building the corresponding social trust mechanism. On this basis, with the help of“ local knowledge”, activism, rhetorical strategies and other dispute resolution techniques, it can organically integrate emotion, reason, and law, fully implement substantive rationality and thoroughly resolve disputes. In the new era, the technical practice of the people’s mediation system has undergone changes and innovations in the rule of law, specialization and branding to ensure in line with the social transformation process of urbanization, commercialization and defamiliarization. The technical logic for the operation of the people’s mediation system revealed by the analysis of the practice of mediation skills is an interpretation of the practical rationality meaning of this approach as a typical representative of the“ Eastern experience”, which will help to further promote the innovation of grassroots governance mechanisms and the optimization of national governance technology.
